29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) On or about February 19, 2015, and at times prior, Cline Design Group, Inc. as the controlling and creating employer, did not ensure that inspections of excavations, the adjacent areas, and protective systems were made by a competent person. Employees of C&D Concrete, Inc., a subcontractor, were exposed to cave-in hazards while preparing to pour concrete for a retaining wall in an excavation approximately 11 feet deep, and 6 feet wide. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about February 19, 2015, Cline Designs, Inc., as the controlling and creating employer, did not ensure that employees of C&D Concrete, Inc., a subcontractor, were protected from cave-in hazards while working in an excavation without adequate protective systems. Employees of C&D Concrete, Inc. were exposed to cave-in hazards while preparing to pour concrete in an excavation 6 feet wide, and 11 feet deep. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").
