29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) On or about February 19, 2015, and at times prior, C&D Concrete, Inc. did not ensure that inspections of excavations, the adjacent areas, and protective systems were made by a competent person. Employees of C&D Concrete, Inc. were exposed to cave-in hazards while preparing to pour concrete for a retaining wall in an excavation approximately 11 feet deep, and 6 feet wide. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about February 19, 2015, C&D Concrete, Inc. did not ensure that its employees were protected from cave-in hazards while working in an excavation without adequate protective systems. Employees of C&D Concrete, Inc. were exposed to cave-in hazards while preparing to pour concrete in an excavation 6 feet wide, and 11 feet deep. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").
