29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalent a dose of fifty percent:    a) On or about May 19, 2015 at the above addressed job site, an employee performing pallet assembly operation using a pneumatic nail gun was exposed to noise dose of 103.7% or an equivalent of 90.2 dBA which was capable of causing permanent hearing loss.  Monitoring was performed for 270 minute sampling time and zero exposure for the remaining 210 minutes of the 8 hour shift.    b) On or about May 19, 2015 at the above addressed job site, an employee performing pallet dismantling operation using a 2-man dismantler was exposed to noise dose of 242.1% or an equivalent of 96.3 dBA which was capable of causing permanent hearing loss.  Monitoring was performed for 361 minute sampling time and zero exposure for the remaining 119 minutes of the 8 hour shift.
