Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: Employees working from a platform/basket attached to the forks of a fork lift were exposed to fall hazards under the following conditions: a) The work platform/basket was not securely attached to the carriage and/or forks of the truck. b) The platform was tilted forward as it was being lowered. c) The employee was not secured to the basket or work platform by the use of a harness and lanyard.
