29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. The employer is failing to identify and address all of the hazards associated with unloading materials through adequate hazard assessment. The most recent example of this was found on the job site located at 5150 NW 40th Street, Lincoln, NE 68521 where the employer had an employee unloading a bundle of three 60 steel trusses from the all-terrain forklift that were held together by a banding strap; the employee was allowed to wear a pair of Thorogood flat sole boots (preferred footwear for ironworkers when connecting steel).

29 CFR 1926.96: Safety-toe footwear for employees shall meet the requirements and specifications in American National Standard for Men's Safety-Toe Footwear, Z41.1-1967. The employer is failing to protect employees from struck by hazards associated with falling loads from material handling equipment through the use of ANSI approved foot wear. The most recent example of this was found on the job site located at 5150 NW 40th Street, Lincoln, NE 68521 where the employer had an employee unloading a bundle of three 60 steel trusses from the all-terrain forklift that were held together by a banding strap; the employee was allowed to wear a pair of Thorogood flat sole boots (preferred footwear for ironworkers when connecting steel) in lieu of steel toe boots when he cut the banding strap the load released from the lift crushing his foot.
