The most recent example of this was found on the job site located at 5150 NW 40th Street, Lincoln, NE 68521 where the employer had an employee unloading a bundle of three 60 steel trusses from the all-terrain forklift that were held together by a banding strap; the employee was allowed to wear a pair of Thorogood flat sole boots (preferred footwear for ironworkers when connecting steel).

29 CFR 1926.96: Safety-toe footwear for employees shall meet the requirements and specifications in American National Standard for Men's Safety-Toe Footwear, Z41.1-1967.  The employer is failing to protect employees from struck by hazards associated with falling loads from material handling equipment through the use of ANSI approved foot wear.  The most recent example of this was found on the job site located at 5150 NW 40th Street, Lincoln, NE 68521 where the employer had an employee unloading a bundle of three 60 steel trusses from the all-terrain forklift that were held together by a banding strap; the employee was allowed to wear a pair of Thorogood flat sole boots (preferred footwear for ironworkers when connecting steel) in lieu of steel toe boots when he cut the banding strap the load released from the lift crushing his foot.
