OSH ACT of 1970 SECTION (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:  On or about February 24, 2015 employees taking measurements for the placement of roof panels at 335 W. Piper Dr., Benton, Kansas were exposed to fall hazards of approximately 20 feet to the ground below.  An employee working from the elevated work platform mounted on the Caterpillar TL1055 Telehandler was not tied off to the work platform.  Among other methods, one feasible and acceptable method to correct this hazard is to require and enforce the use of personal fall arrest or restraint systems while employees are working in elevated work platforms as required in the "Caterpillar Operation & Safety Manual; Telehandler Personnel Work Platform", page 1-9 first bullet point, "During operation, occupants in the platform must wear a full body harness with an lanyard attached to an authorized lanyard anchorage point." In addition, the "Instruction Manual & Work Safe Program" for Arrow Material Handling Work Platforms, page 8, Fall Hazards.  "Each person being lifted in excess of ten (10) feet above the ground level of the next lower surface must wear an approved fall arrest device.  Such fall arrest devices shall be securely fastened to the anchor points supplied with the unit, installed, and inspected per the manufacturer's instructions."

29 CFR 1910.178(l)(3)(i)(M): The employer did not review the operating instructions, warnings, or precautions listed in the operator's manual for the types of vehicle that the employee is being trained to operate:  On or about February 24, 2015 employees taking measurements from an elevated work platform at 335 W. Piper Dr., Benton, Kansas were exposed to hazards associated with forklift instability.  The employer did not train the operator's of the Caterpillar TL1055 Telehandler on the limitations of related to the forklift when elevating personnel in work platforms.

29 CFR 1926.454(a)(3): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the proper use of the scaffold, and the proper handling of materials on the scaffold:  On or about February 24, 2015 employees working from elevated work platforms at 335 W. Piper Dr., Benton, Kansas were exposed to hazards associated with scaffolds such as but not limited to falls, access, work near electrical power lines, elevated work platforms, and structural stability.  The employer did not provide training to employees.
