29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace.  a) On or about 2/23/2015, Commercial Marine Service employees were working at 1545 Port Street, in Memphis, TN, and did not ensure that employees, that are required to wear respirators while working in a confined space being exposed to hazardous materials (including but not limited to wood dust, particulates, vapors, soybean oil, ethanol, and methanol) were medically cleared to wear tight fitting respirators.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function.   a) On or about 2/23/2015, Commercial Marine Service employees were working at 1545 Port Street, in Memphis, TN, and the employer did not ensure employees were clean shaven when required to wear respirators for protection from hazardous materials during cleaning procedures in a confined space.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1)(i): The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet.  (a) On or about 2/23/2015, Commercial Marine Services employees working at 1545 Port Street, in Memphis, TN, for which the employer did not maintain a current up to date chemical inventory list that reflected materials being used on site (including but not limited to NAPA Antifreeze and Majic Spray Paint (eye, kin, and respiratory tract irritants). Without proper information on hazardous materials, employees could mis-handle hazardous materials and expose themselves to skin, eye, and respiratory irritations.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
