On 2/25/2015, employees from Continental Commercial Products L.L.C. were working in the maintenance shop. The maintenance shop had a Delta sander, serial number 95 E 91885. The sander was plugged in, had two panels removed and was not locked or tagged out with an energy isolating device.

Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, was not constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. On 2/25/2015, Continental Commercial Products L.L.C. had not installed a tongue guard on a Baldor pedestal grinder in the maintenance shop to ensure the diameter never exceeded one-fourth inch.
