29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:    a) West Side of Building - The employer used a Gradall 534C material handler to support a scaffold platform that was not designed by the manufacturer for that purpose, on or about February 26, 2015.      b) East Side of Building - The employer used a Gradall 534D-42 material handler to support a scaffold platform that was not designed by the manufacturer for that purpose, on or about February 26, 2015.    Abatement certification and documentation required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.451(f)(5): Scaffolds were moved horizontally while employees were on them although the scaffolds were not designed for such movement by a registered professional engineer:  a) West Side of Building - An employee was observed standing on an elevated work platform attached to the forks of a Gradall 534C while the operator moved the platform horizontally and was exposed to an approximate 8 foot fall hazard, on or about February 26, 2015.  No abatement certification or documentation required.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  a) Job Site - Employees working from elevated work platforms attached to the tines of Gradall material handlers were not trained in the recognition and avoidance of hazards associated with elevated work platform usage and how to correct those hazards, such as but not limited to, fall hazards, on or about February 26, 2015. No abatement certification or documentation required.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks; the load engaging means was not fully lowered when leaving a powered industrial truck unattended:    a) West Side of Building - Employees were observed working from an elevated work platform placed on the forks of a Gradall 534C material handler. The operator had dismounted the material handler leaving no one at the controls, employees were exposed to an approximate 15 foot fall hazard, on or about February 26, 2015.    Abatement certification and documentation required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
