29 CFR 1910.178(l)(4)(ii): The employer did not ensure that refresher training, including an evaluation of the effectiveness of that training, was conducted as required by paragraph (i)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely in accordance with subparagraph [B]: 923 W. Railroad St., Kearney, NE 68845 (Site-Wide): The employer is failing to ensure that an employee was not allowed to operate forklifts without their performance being evaluated following an incident where an employee was struck by a car which was struck by a forklift. The forklift operator continued to operate the forklift before receiving refresher training. Abatement certification is required for this violation. Abatement certification sheet is enclosed with the citation.
