Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a falling load. On or about February 26, 2015 at 476 Hwy 247, Bonaire, GA.: Employees were using a single leg chain sling attached to an excavator bucket to hoist bundles of rebar from a flatbed truck. The material was rigged in such a way that the load was unbalanced exposing employees to being struck by the falling load.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about February 26, 2015 at 476 Hwy 247, Bonaire, GA.: The employees removing bundles of rebar from a flatbed truck were not trained in proper rigging techniques. Two bundles were lifted by the middle of the three wires which is used to hold the rebar together during shipment, the bundles were not balanced during the lift, and the chain used for the lift compatible for this particular lift.
