29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) On or about February 26, 2015, at the above mentioned jobsite, employees were exposed to a 10.3 foot fall hazard while applying mastic cement (bull) on the flashing and membrane in the open soffit (cubby hole) on a two-story residential home without a means of fall protection.    b) On or about February 26, 2015, at the above mentioned jobsite, employees were exposed to a 15.6 foot fall hazard while applying "Peel "N Stick" on the roof of a two-story residential home without a means of fall protection.    The Latite Roofing and Sheet Metal, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13) or its equivalent standard, which was contained in OSHA inspection number 910718, citation number 1, item number 1 and was affirmed as a final order on 12/4/2013, with respect to a workplace located at 4680 Mimosa Place, Coconut Creek, FL.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:    On or about February 26, 2015, at the above mentioned jobsite, an employee was exposed to a fall hazard of approximately 10.3 feet while applying mastic cement (bull) on the flashing and membrane in the open soffit (cubby hole) on a two-story residential home, which the employer had not rigged the fall protection to prevent a fall of greater than 6 feet nor contact with a lower level.    The Latite Roofing and Sheet Metal, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.502(d)(16)(iii) or its equivalent standard, which was contained in OSHA inspection number 315498154, citation number 1, item number 1 and was affirmed as a final order on 04/29/2011, with respect to a workplace located at 4754 Clark Road, Sarasota, FL 34231.
