OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to struck by hazards while operating a Utility Vehicle from the passenger side seat:      (a)  On or about 25 March 2015, at the facility located at 4020 Winchester Ave, Kansas City, MO., one employee was exposed to being struck-by and crushed, when he was operating a John Deere "Gator" Utility Vehicle while sitting in the passenger seat of the vehicle. The inability to safely control the moving vehicle from the passenger seat of the vehicle caused him to accidentally drive into a parked truck container trailer, whereby he received life threatening injuries that later resulted in his death.          Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, and service rooms must be kept clean and orderly and in a sanitary condition:      (a)  On or about 25 March 2015, in the maintenance shop employees were exposed to slip, trip, falls, struck-by and caught-in hazards, in that the work areas were not kept in a clean and orderly condition.  Hand tools, power tools, replacement parts and various types of equipment being repaired were cluttered about the shop area. 29 CFR 1910.303(b)(1): Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees:      (a) On or about 25 March 2015, in the maintenance shop area employees were exposed to serious injuries from electrical shock hazard, in that the connector plug and outer insulation of the extension cord used to power a chop saw, was damaged and defective. (a)  On or about 25 March 2015, at the main work table in the maintenance shop, employees were exposed to electric shock and or fire hazards, in that the unused openings of the electrical outlet box used to connect various power tools and equipment was not effectively closed and protected. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On or about March 25, 2015 at the facility located at 4020 Winchester Ave. Kansas City, MO., the employer had not developed, implemented and/or maintained a written hazard communication program for the large quantities of motor oil, transmission fluid, hydraulic oil and fuels maintained on site. As a result, employees were to chemical contact hazard, carcinogenic and or health hazards. 29 CFR 1910.22(d)(1): In every building or other structure, or part thereof, used for mercantile, business, industrial, or storage purposes, the loads approved by the building official must be marked on plates of approved design which will be supplied and securely affixed by the owner of the building, or his duly authorized agent, in a conspicuous place in each space to which they relate. Such plates must not be removed or defaced but, if lost, removed, or defaced, will be replaced by the owner or his agent.   (a) On or about 25 March 2015, in the maintenance shop area employees were exposed to overhead struck-by injuries, in that a job made shelving unit and overhead storage area had been erected without posting signage identifying the maximum load limit for the storage areas. 29 CFR 1910.132(d)(2): The employer must verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  (a) On 27 February 2015, at the facility located 4020 Winchester Ave, Kansas City, Mo., the employer had not completed a written certification that a workplace hazard assessment had been completed and verified.  As a result, employees were exposed to serious injuries from fall hazards, hearing and eye injuries by not properly assessing the workplace for needed Personal Protective Equipment.
