29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     (a)Top Notch Construction at 740 S. Washington St., Denver, CO 80012: On and before March 2nd, 2015, the exposing employer failed to ensure that each employee performing residential construction activities 6 feet or more above lower levels was protected by effective fall protective measures.  Employees were observed performing roofing work in preparation for the installation of a parapet wall. The condition exposed employees to falls of approximately 28 feet from the roofs edge and 20 feet from the balcony.    (b) Top Notch Construction at 740 S. Washington St., Denver, CO 80012: On and before March 2nd, 2015, the exposing employer failed to ensure that each employee performing residential construction activities 6 feet or more above lower levels was protected by effective fall protective measures.  Specifically, an employee was observed working on a second floor balcony without guard rails and which was also not completely decked forcing the employee to walk on the floor joists. The condition exposed the employee to fall hazards of approximately 20 feet from a balcony.    (c) Top Notch Construction at 740 S. Washington St., Denver CO 80012: On and before March 2, 2015, the exposing employer failed to ensure that each employee performing residential construction activities 6 feet or more above lower levels was protected by effective fall protective measures.  Specifically, an employee was observed climbing over a 4 foot separation wall and walking on floor trusses without the use of a fall protection system.  The condition exposed the employee to fall hazards of approximately 10 feet.

Washington St., Denver, CO 80012: On and before March 2, 2015, the exposing employer failed to ensure that the three stairways on site had at least one stair rail system along each unprotected side or edge.  Condition exposed employees utilizing the stair cases to access the basement and second floor to fall heights as high as 10 feet while using the stairs.

29 CFR 1926.1053(b)(1) When a portable ladders was used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.  (a)Top Notch Construction at 740 S. Washington St., Denver, CO 80210: On and before March 2nd, 2015, the exposing employer failed to ensure that a ladder being utilized to access the roof from the second floor extended at least 3 feet above the landing surface.  Specifically, an employee was observed utilizing a 6 foot stepladder to access the roof surface, which was approximately 9 feet above the deck of the balcony.  The condition exposed employees to fall hazards while accessing the roof.

29 CFR 1926.1053(b)(4): A step ladder was not used only for the purpose for which it was designed.   (a)Top Notch Construction at 740 S. Washington St., Denver, CO 80012: On and before March 2nd, 2015, the exposing employer allowed the top rung of a step-ladder to be used as a step contrary to manufacturers instructions. Specifically, an individual was observed utilizing a 6 foot step ladder located on a second floor balcony to access the roof, located at approximately 9 feet, which required the employee to use the top rung of the step ladder to climb onto and off of the roof. The condition exposed an employee to a fall hazard of approximately 9 feet.

(a)Top Notch Construction at 740 S. Washington St., Denver, CO 80012: On and before March 2nd, 2015, the exposing employer did not ensure that employees were wearing head protection while an employee threw material off the roof exposing employees on the second level balconies. The condition exposed employees working on the second floor to potential head injury from debris being thrown from the roof onto the second story balcony.
