29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  Trench located on the South side of Fire Station #21 located at 3454 Ames Avenue, Omaha, NE 68111: The employer is failing to ensure that safe means of egress is located in trenching excavations deeper than 4 feet. On or about March 2, 2015 employees of Aspen Plumbing, LLC were located in a trench deeper than 4 feet without a means of egress.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  On the South side of Fire Station #21 located at 3454 Ames Avenue, Omaha, NE: The employer is failing to ensure that employees working inside of the trench were protected from loose soil and/ or other materials from rolling in to the excavation. The spoil piles were located on the sides of the open trench within 2 feet and were being kept in place with a retaining device.

On or about March 2, 2015, employee were observed working inside of a trench deeper than 5 feet in the ground, without a means of egress and with spoil piles within 2 feet of the trench.

Trench located on the South side of Fire Station #21 located at 3454 Ames Avenue, Omaha, NE 68111: The employer is failing to protect employees from cave-ins with an adequate protective system while they are inside of a trench, deeper than 5 feet. On or about March 2, 2015, employees were observed working inside of a 5.7 foot deep trench without a protective system such as but not limited to a trench shielding box, hydraulic shoring and/ or sloping or benching of the soil.
