29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: Trench located on the South side of Fire Station #21 located at 3454 Ames Avenue, Omaha, NE 68111: The employer is failing to ensure that excavations, adjacent areas and protective system inspection are conducted by a competent person prior to allowing sub-contractor's employees to enter a trench / excavation to perform work. On or about March 2, 2015, employees were observed working inside of a trench deeper than 5 feet in the ground, without a means of egress and with spoil piles within 2 feet of the trench.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. Trench located on the South side of Fire Station #21 located at 3454 Ames Avenue, Omaha, NE 68111: The employer is failing to remove sub-contractor's employees exposed to hazardous conditions such as but not limited to possible cave-ins, lack of protective systems, etc. On or about March 2, 2015, employees of Aspen Plumbing were observed working inside of a trench deeper than 5 feet in the ground, without a means of egress and with spoil piles within 2 feet of the trench.
