29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user.    a) Products Finishing, Inc. / 2002 Greengarden Road, Erie, PA: On or about March 2, 2015 employees utilized air purifying half face respirators with cartridges (3M brand #7580 with 3M brand cartridges P100A) on a voluntary basis while working at the plating tanks. The employer did not establish portions of a Respiratory Protection Program that covered medical evaluations and respirator maintenance and care.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee used the respirator in the workplace:  a) Products Finishing, Inc. / 2002 Greengarden Road, Erie, PA: On or about March 2, 2015 employees utilized air purifying half face respirators with cartridges (3M brand #7580 with 3M brand cartridges P100A) on a voluntary basis while working at the plating tanks. Employees were not provided with a medical evaluation prior to the use of the air purifying half face mask respirator.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  a) Products Finishing, Inc. / 2002 Greengarden Road, Erie, PA: On or about March 2, 2015 employees utilized air purifying half face respirators with cartridges (3M brand #7580 with 3M brand cartridges P100A) on a voluntary basis while working at the plating tanks. Employees that voluntarily used half mask respirators were not provided with the information in Appendix D to this section.  b) Products Finishing, Inc. / 2002 Greengarden Road, Erie, PA: On or about March 2, 2015 employees voluntarily used filtering facepiece resiparators (dust masks) (3M brand 8210 N95) during grinding operations. Employees that voluntarily used filtering facepiece respirators were not provided with the information in Appendix D to this section.

Employees worked around and/or with chemicals that included, but were not limited to, hydrochloric acid, sulfuric acid, and acetone.
