OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer allowed employees to lubricate a Kysor Johnson Model J horizontal band saw blade by pressing a tube of Cut Ease Stick Lubricant against the running saw blade, exposing the employee to possible amputation hazards. On or about February 18, 2015, a Kysor Johnson Model J horizontal band saw was being lubricated by an employee where the employee was pressing a tube of Cut Ease Cutting Lubricant against the saw blade while the saw was running. The employees hand was drawn into the saw blade, where the employee's left middle finger was caught by the saw blade and amputated at the second knuckle.

29 CFR 1904.32(a)(4): The employer did not post an OSHA 300A Form or equivalent by February 1 thru April 30. (a) FACILITY WIDE - On or about February 26, 2015, the employer failed to post the annual summary of work-related injuries and illnesses. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
