29 CFR 1910.95(g)(5)(ii): "Mobile test van exception." Where mobile test vans are used to meet the audiometric testing obligation, the employer shall obtain a valid baseline audiogram within 1 year of an employee's first exposure at or above the action level. Where baseline audiograms are obtained more than 6 months after the employee's first exposure at or above the action level, employees shall wear hearing protectors for any period exceeding six months after first exposure until the baseline audiogram is obtained.     a. On or about March 3, 2015, in the curling, shine and production areas temporary employees were exposed to noise levels between 8.2 decibel to 90.5 decibel for more than six months.  The noise levels exceeded the action level of 8.5 decibels. The temporary employees were not required to wear hearing protection and thereby were exposed to the hazards associated with noise exposer.

29 CFR 1910.95(k)(1): The employer shall train each employee who is exposed to noise at or above an 8-hour time weighted average of 85 decibels in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program.  On or about March 3, 2015, in the curling, shine area and production areas temporary employees were exposed to noise levels between  87.2 decibels to 90.5 decibels which exceeds the action level of 85 decibels. The employer did not ensure that each temporary employee exposed to noise at on above the action level was trained on the requirements  of 1910.95, the noise standard.

29 CFR 1910.95(k)(3): The employer shall ensure that each employee is informed of the following:  a. on or about March 3,2015, in the curling, shine and production areas, temporary employees were exposed to noise levels between 87.2  decibels to 90.5 decibels. The employer did not ensure each temporary employee was informed on the effect on hearing; the purpose of hearing protectors and the purpose of audiometric testing.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.      a. On or about March 3, 2015,  in the production area,  the employer did not provide a guard to protect employees from coming in contact with the rotating mixing blade on the icing machine.  Employees were exposed to the hazards associated with rotating parts.     b.  On or about March 3, 2015, in the production area, the employer did not adequately guard the Lematic Pillow Pack Machine exposing employees to inrunning nip points.  Employees were exposed to crushing hazards.      c.   On or about March 3, 2015,  in the production area, the employer did not adequately guard the Kliklock box folding machine exposing employees to the point of operation.  Employees were exposed to crushing hazards.

29 CFR 1904.31(b)(2): If I obtain employees from a temporary help service, employee leasing service, or personnel supply service, do I have to record an injury or illness occurring to one of those employees? You must record these injuries and illnesses if you supervise these employees on a day-to-day basis.    a. On or about March 3, 2015, in the facility, the temporary worker's recordable injuries were not recorded on the company OSHA 300 logs with the company's fulltime employees.  The temporary employee injuries  were recorded separately on a temporary worker OSHA log.
