OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. The employer is failing to protect employees from potential struck by and caught between hazards associated with failing to use required tools and communications means as required in the manufacturers operators manual. The most recent example of this was found on the job site located at 14th Street and Military Road, Lincoln, NE 68505 where the employer has employees disconnecting drill rods using tools and methods not authorized in accordance with the operators manual for the American Auger DD-110 Horizontal Drilling Machine. Instances include but are not limited to: i. Employees leveraging the Bukup Tongs against the ground and the drill machine operator using the power of the machine to assist in breaking the drill rods apart, a practice not accepted by the Horizontal Direction Drilling Good Practices Guidelines. ii. Employees using the power of a CAT Model 430D Back Hoe and applying pressure directly to the Bukup Tongs as a method of applying leverage to break the drill rods apart. iii. Employees attempting to communicate with hand signals from 570 feet away and obstructed view in lieu of the radio communications mandated in the operators manual for the DD-110 Horizontal Drilling Machine. Among other methods, feasible and acceptable methods of abatement are: 1. When disconnecting drill rods from each other, use either a hydraulic or manual remote breakout wrench which will ensure that employees are clear of the rods as they are slowly separated apart. 2. When conducting horizontal boring operations the employer shall use radio communications as the means of communicating between the drill and exit site.
