29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about March 18, 2015 employees were exposed to noise levels that exceeded 85 dBA, as an 8 hour time weighted average, without evaluating noise levels, audiogram evaluation and training on noise. a) The saw operator was exposed to 85.22 dBA, as an 8 hour time weighted average. The employee was sampled on March 18, 2015 for 454 minutes, the remaining 26 minutes was calculated as 0 (zero) exposure time. b) The drill/notch machine operator was exposed to 88.93 dBA, as an 8 hour time weighted average. The employee was sampled on March 18, 2015 for 452 minutes, the remaining 28 minutes was calculated as 0 (zero) exposure time. c) The router operator was exposed to 89.54 dBA, as an 8 hour time weighted average. The employee was sampled on March 18, 2015 for 465 minutes, the remaining 15 minutes was calculated as 0 (zero) exposure time. d) The die punch press operator was exposed to 88.50 dBA, as an 8 hour time weighted average. The employee was sampled on March 18, 2015 for 421 minutes, the remaining 59 minutes was calculated as 0 (zero) exposure time. e) The assembly employee was exposed to 88.58 dBA, as an 8 hour time weighted average. The employee was sampled on March 18, 2015 for 440 minutes, the remaining 40 minutes was calculated as 0 (zero) exposure time.
