29 CFR 1926.1101(d)(5): As supervisor of the entire project, the general contractor did not ascertain whether the asbestos contractor was in compliance with the asbestos standard, and did not require such contractor to come into compliance with this standard: (a) The Wharf - Southwest Waterfront - On or about March 3, 2015, the demolition subcontractor, The Anderson Company's workers were digging up, breaking up and removing cement pipes, encased in a concrete wall, containing 30 percent to 45 percent Chrysotile asbestos and the general contractor did not ensure that this operation was conducted in compliance with a Class II asbestos work operation. (b) The Wharf - Southwest Waterfront - On or about March 3, 2015, the asbestos contractor, GOEL Services' workers, lined roll off containers, inspected the asbestos containing material being loaded in the containers and did not insure that the material had been kept wet until it had been loaded for transport away from the demolition site. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
