OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards caused by the operation of a powered industrial vehicle without the use of a seatbelt:   Pallet Storage Yard: On or about March 6, 2015, employee(s) were exposed to a struck-by hazard from the operation of a Caterpillar 30 Industrial Truck (Model GC15, SN: 2EM05997) without the use of a seatbelt.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Cutting Area, Trim Track: On or about March 6, 2015, and times prior there to, employee(s) performing cutting operations using a Smart Products Power Feed Trim Saw (model and serial number not found) were exposed to continuous noise at a dose of 160.1% (8-Hour Time Weighted Average sound level of 85 dBA) during the 432 minute sampling period. For a full eight hour work shift this exposure is equivalent to an average sound level of 93.3 dBA. Exposure calculations include a zero increment for the 48 minutes not sampled.  b) Pallet Station #2: On or about March 6, 2015, and times prior there to, employee(s) performing pallet repair operations using a Grip Rite pneumatic nail gun (Model GRTCN64) were exposed to continuous noise at a dose of 197.1% (8-Hour Time Weighted Average sound level of 85 dBA) during the 418 minute sampling period. For a full eight hour work shift this exposure is equivalent to an average sound level of 94.8 dBA. Exposure calculations include a zero increment for the 62 minutes not sampled.  c) Pallet Station #1: On or about March 6, 2015, and times prior there to, employee(s) performing pallet repair operations using a Grip Rite pneumatic nail gun (Model GRTCN64) were exposed to continuous noise at a dose of 106.6% (8-Hour Time Weighted Average sound level of 85 dBA) during the 415 minute sampling period. For a full eight hour work shift this exposure is equivalent to an average sound level of 90.4 dBA. Exposure calculations include a zero increment for the 65 minutes not sampled.
