OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. Within the maintenance shop, on or about 03/04/15: A surface mounted, two-post Rotary automotive lift in maintenance bay number six was being used without the left side swing arm restraints being operational. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Ensure the automotive lift is operated in accordance with the Automotive Lift Institute, Inc. standard for automotive lifts, paragraph 4.4.2 which states, The operator shall use all applicable safety features provided on the automotive lift, and operate the lift in accordance with the instructions furnished by the lift manufacturer. In addition, with regard to lift inspections, follow paragraph 5.6.2.13 which states; On lifts requiring swing arm restraints, the swing arm restraints shall be inspected. Report improper function, excessive wear or damage. Also, with regard to lift operator training, follow paragraph 4.2.1 which states; The owner or employer shall ensure that operators of automotive lifts are instructed in the safe use and operation of the lift using the manufacturer provided instructions and warning labels and the Automotive Lift Institute publications, "Quick Reference Guide, Vehicle Lifting Points for Frame Engaging Lifts", "Lift It Right" and "Safety Tips" and this ALOIM Standard. Equivalent documents may be substituted for proprietary materials.
