29 CFR 1910.23(a)(2): Ladder way floor opening(s) or platform(s) were not guarded by a standard railing with standard toe board(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening.    On or about 3 March 2015, and at times prior thereto, ladder way platforms were not guarded at the following locations:  1) Vessel F4701 Inlet Coalescer ladder way was missing a swing gate with a height greater than 6 feet.  2) F3701 Discharge Coalescer ladder way was missing a swing gate with a height greater than 6 feet.  3) F4702 Comp Discharge Coalescer ladder way was missing a swing gate with a height greater than 6 feet.  4) Process Skid ladder way was missing a swing gate with a height of approximately 18 feet.

29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices.     On or about 3 March 2015, and at times prior thereto, the safety-instrumented systems (SIS) had not been tested, inspected, and maintained in accordance with recognized and generally accepted good engineering practices (RAGAGEP).  1) Emergency shutdown systems were not tested and inspected per ANSI/ISA 91.00.01 2001 for year 2014.  2-4) withdrawn  5) Relief Valves that were designated Car Sealed were found to be missing the seal during the inspection and out of compliance per ASME VIII, Appendix M.

On or about 3 March 2015, and at times prior thereto, the employer did not perform a building site evaluation or blast study to determine if building structures for normal occupancy are specifically designed to resist explosion, fire, or toxic material release as a result of a catastrophic event from the natural gas liquid process conducted at the T.R. Marshall Hub, potentially exposing employees to the hazards of fire, explosion, and toxic material release.
