OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and impalement hazards:    a.   On or about March 4, 2015, on the southeast side of a new commercial construction site, employees were using a staircase that had protruding conduit to which an employee could trip and fall, exposing employees to fall and impalement hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a.  On or about March 4, 2015, on the southeast side of a new commercial construction building, two employees working for RSCC, LLC installing aluminum structural beams for windows were not protected from a 21 feet 4 inch fall hazard by the use of a personal fall protection system.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.    a.  On or about March 4, 2015, on the south side of a new commercial construction building, an employee was using a breezeway that was not protected with guardrails, the employee was not protected from a 17 feet 2 inch fall hazard.    b.  On or about March 4, 2015, on the south side of a new commercial construction building, an employee walking/working near an elevator shaft was not protected with guardrails, the employee was not protected from a 20 feet fall hazard.    c.  On or about March 4, 2015, on the southeast side of a new commercial construction building, an employee walking/working around wall openings was not protected with guardrails, the employee was not protected from a 16 feet 4 inch fall hazard.
