29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) On March 6, 2015, an employee was exposed to a noise dose of 62.9% over a 457 minute time period. 62.9% is equivalent to a 8-hour time weighted average of 87 decibels. b) On March 6, 2015, an employee was exposed to a noise dose of 52.2% over a 319 minute time period. 52.2% is equivalent to a 8-hour time weighted average of 85.3 decibels. An effective Hearing Conservation Program includes, but is not limited to: 1. Noise level monitoring. 2. Audiometric testing. 3. Wearing of hearing protection. 4. Training program. 5. Record keeping.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) The employer had not developed a hazard communication program for employees using canine grooming products, kennel cleaning products and other chemical products. An effective hazard communication program includes, but is not limited to, the following: 1. A written hazard communication program. 2. Ensure the chemical product's container labeling is maintained and secondary containers are properly labeled. 3. Obtaining safety data sheets for the chemical products used by employees and keeping them readily available for employee usage. 4. Ensure employee training includes explanation of the employer's hazard communication program, information on the information included in safety data sheets, the hazards associated with the chemical products, methods the employers has implemented to minimize the employee's exposure to the chemical product, and what actions the employee should take if they are experiencing a reaction to the chemical product.
