OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) On or about March 9, 2015 or prior thereto, in the back automotive bay, employees were exposed to struck-by hazards while working around automotive lifts including a 9,000 Pound Capacity Challenger Lift, Model 14341, Serial Number 4326. Employees were working underneath raised vehicles and the lift had not been inspected, nor had employees been trained in its use. b) On or about March 9, 2015 or prior thereto, in the back automotive bay, employees were exposed to struck-by hazards while working around automotive lifts including a 9,000 Pound Capacity Challenger Lift, Model 14341, Serial Number 4327. Employees were working underneath raised vehicles and the lift had not been inspected, nor had employees been trained in its use. c) On or about March 9, 2015 or prior thereto, in the front service bay, employees were exposed to struck-by hazards while working around automotive lifts including a 3,000 Pound Capacity Lift, Model and Serial Number unknown. Employees were working underneath raised vehicles and the lift had not been inspected, nor had employees been trained in its use. d) On or about March 9, 2015 or prior thereto, in the middle automotive bay, employees were exposed to struck-by hazards while working around automotive lifts including a Rotary Lift, Serial Number 050H1000M-JA. Employees were working underneath raised vehicles and the lift had not been inspected, nor had employees been trained in its use. Abatement certification and documentation is required for this item.
