OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 SECTION (5)(a)(1): The employer did not furnish a place of employment which was free from recognized hazards that was causing or likely to cause death or serious physical harm to employees. Employees were exposed to hazards of being struck-by the load, should the load slip off the load hook on the hoist at the heat sealer. The hook had a broken safety latch and a fabric rigging strap. Among other methods, one feasible method of abatement is to replace the damaged safety clip on the load hook, conduct periodic inspections of all hoists for wear, deterioration and malfunction and provide support structure ratings as per ASME B30.16-1993.
