29 CFR 1910.67(b)(2): A modified aerial lift(s) was not certified by the manufacturer or NRTL as being at least as safe as the equipment was before modification:    At or near the job site located at 1710 Wildwood Rd in Alexander, Arkansas, employees were required to use a field modified articulating aerial lift, that was not certified by the manufacturer or NTRL as being at least as safe as before modification. The aerial lift was being used to lower large limbs and blocks of tree trunk to the ground. These conditions exposed the employees to the hazard of falling from and elevation.

29 CFR 1910.67(c)(2)(v): A body belt is not worn and a lanyard attached to the boom or basket when working from an aerial lift:    At or near the job site located at 1710 Wildwood Road in Alexander, Arkansas, where employees were de-limbing and removing a tree, an employee required to work from an elevated articulating aerial lift was not wearing a body belt and lanyard. These conditions exposed the employee to the hazard of falling to the ground below.

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    On or about March 10, 2015, and at times prior thereto, where employees were required to operate chain saws and wood chippers, the employer did not initiate or maintain a monitoring program, exposing employees to hazardous levels of noise.

29 CFR 1910.333(c)(3)(i)(A):   When an unqualified person is working in an elevated position near overhead lines, the location shall be such that the person and the longest conductive object he or she may contact cannot come closer to any unguarded, energized overhead line than the following distances:    (1)  For voltages to ground 50kV or below - 10 feet (305 cm);  (2)  For voltages to ground over 50kV - 10 feet (305 cm) plus 4 inches (10 cm) for every 10kV over 50kV.    (A)  The employer did not ensure that unqualified personnel working in an elevated position and the longest conductive objects maintained the required distance from any unguarded, energized overhead power line.    On or about March 10, 2015 and at times prior thereto, at the job site located at 1710 Wildwood Rd in Alexander, Arkansas, were employees were engaged in tree removal operations, unqualified employees were required to work within 10 feet of the energized overhead line providing electrical service to the residence. These conditions exposed the employees to the hazard of electric shock.
