29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about March 11, 2015, at 2120 Stephen Place, New Braunfels, TX, the employer failed to ensure the employee was trained on the hazards associated with working from an aerial lift and to understand the procedures to control or minimize those hazards. The employee was observed working from a Genie aerial lift patching the stucco and he was not wearing a fall harness. The employee was exposed to a fall hazard of approximately thirty six feet.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: On or about March 11, 2015, at 2120 Stephen Place, New Braunfels, TX, the employer failed to ensure the employee working from an aerial lift basket had fall protection. The employee was observed working from a Genie aerial lift patching the stucco and he was not wearing a fall harness. The employee was exposed to a fall hazard of approximately thirty six feet.
