29 CFR 1926.651(i)(2): Excavations below the level of the base or footing of any foundation or retaining wall that could be reasonably expected to pose a hazard to the employees was not prohibited. At the Seaholm Substation East Screen Wall, 100 West Avenue, Austin, TX, 78701, on or about March 4th, 2015 and at times prior thereto, four (4) employees were installing rebar during intermittent rain in an excavation approximately twelve feet and six inches (12'6" ) deep by one hundred and fifty foot (150') long with exposed unknown horizontal and vertical concrete structures that were not supported, exposing the employees to the hazard of being struck by falling objects.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. At the Seaholm Substation East Screen Wall, 100 West Avenue, Austin, TX, 78701, on or about March 4th, 2015 and at times prior thereto, the competent person on site for an unprotected excavation measuring approximately twelve feet and six inches (12'6 ") deep by one hundred fifty feet (150') long, failed to remove four (4) employees who were tying rebar during intermittent rain, exposing the employees to a cave-in hazard.
