OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards or other serious injuries while operating a Scissor Lift where no scheduled and or routine maintenance, and pre-operation function tests had been conducted: On March 12, 2015 and dates prior, employees engaged in exterior building painting activities were exposed to a falling/crushing hazard while working from a scissor lift (Serial # GS-0566), having inoperable/malfunctioning controls and or safety devices. The employer had not ensured that the required scheduled maintenance, and pre-operation function tests were being performed per the manufacturers requirements. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.452(w)(6)(i): Employee(s) were allowed to ride on scaffolds when the surface on which the scaffold was moved was not within 3 degrees of level, and/or not free of pits, holes, and obstructions: On or on dates prior to March 12, 2015 at the jobsite located at 8801 NE Parvin Road in Kansas City, MO., employees were attempting to re-position a scaffold on a parking lot surface area that was greater than 3 degrees of level. As a result, the scaffold toppled the concrete surface where one employee sustained fatal injuries from the fall. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
