29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: The employer does not ensure that each employee is instructed in the recognition and avoidance of unsafe conditions. This violation was observed on or about March 13, 2015, on the north side of the building where employees were exposed to fall and impalement hazards when performing steel erection activities without being provided instruction on recognizing unsafe conditions such as, but not limited to, not securing a pallet to the forks of a forklift and not capping reinforcing steel. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee is instructed in the recognition and avoidance of unsafe conditions.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied: The employer does not ensure that supported scaffold platforms are attached to the forks. This violation was observed on or about March 13, 2015, on the north side of the building where an employee was exposed to a fall hazard when welding supports for decking from a wooden pallet that was elevated using an Angus-Palm rough terrain forklift without the pallet being attached to the forks of the forklift. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that supported scaffold platforms are attached to the forks.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. The employer does not ensure that each employee on a scaffold more than 10 feet above a lower level is protected from falling to the lower level. This violation was observed on or about March 13, 2015, on the north side of the building where an employee was exposed to a fall hazard greater than 10 feet when welding supports for decking from a wooden pallet that was elevated using an Angus-Palm rough terrain forklift without a fall protection system in place. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee on a scaffold more than 10 feet above a lower level is protected from falling to the lower level.

This violation was observed on or about March 13, 2015, on the north side of the building where an employee was exposed to impalement hazards when performing welding activities above a brick wall with protruding rebar that was not guarded. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all protruding reinforcing steel is guarded to eliminate impalement.
