29 CFR 1926.52(a): Protection against the effects of noise was not provided for employee(s) exposed to sound levels which exceeded those listed in Table D-2 of 29 CFR part 1926.52: (a) On or about 3/18/2015, at jobsite at 164-01 Foch Boulevard, Jamaica, NY 11434: Employer did not provide employees with protection against the effects of noise while the employees were using power chipping tools and vacuum cleaners to remove brick, mortar and tar from the 5th story façade of the building. Sound pressure levels at ground level, at a distance of 20-25 feet from the building and 5 storys below the work ranged from 70-76 dBA, which, using a conservative estimate of the 5th floor work taking place at a height of 40 feet, gives an estimated exposure at a distance of 3 feet from the tools of at least 92.5 to 98.5 dBA.
