29 CFR 1926.404(b)(1)(iii)(C): Where an assured equipment grounding conductor program was being utilized, the employer did not ensure that each cord set, attachment cap, plug and receptacle of cord sets, and any equipment connected by cord and plug, except cord sets and receptacles which are fixed and not exposed to damage, were not visually inspected fofore each day's use for external defects, such as deformed or missing pins or insulation damage, and for indicationsof possible internal damage. a) On or about March 12, 2015- job site at 63-06 Beach Front Road, Arverne, NY 11692 The employer permitted an employee to use a electric screw gun that was powered by a flexible cord set with damaged insulation. WRITTEN ABATEMENT CERTIFICATION IS NOT REQUIRED.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: a)On or about March 12, 2015- job site at 63-06 Beach Front Road, Arverne, NY 11692 The employer permitted an employee to work on an extendable boom platform, more than 10 feet above the next lower level without fall protection. Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: WRITTEN ABATEMENT CERTIFICATION IS NOT REQUIRED.
