29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there was an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. On 3/13/2015, workers from Bush Construction were setting floor joists for the second story of an apartment building located on the north side of Miralago Way in St. Peters, MO. Two employees were not required to wear eye protection while using pneumatic nail guns.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system.
