29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.      a) Lot 43, Highspire Court, Wildflowers, Medford, NJ:  On or about 03/12/2015 an employee was observed working from the second floor top plate, securing roof trusses, without using any form of fall protection. The employee was exposed to a fall hazard of greater than 18 to the ground below.  The employer had not initiated a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition.        NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.     a) Lot 43, Highspire Court, Wildflowers, Medford, NJ:  On or about 03/12/2015 an employee was observed working from the second floor top plate, securing roof trusses, without using any form of fall protection. The employee was exposed to a fall hazard of greater than 18 to the ground below.  The employer had not provide a training program for employees exposed to fall hazards to enabled the recognition of the hazards of falling and the procedures to minimize these hazards.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.     a) Lot 43, Highspire Court, Wildflowers, Medford, NJ:  On or about 03/12/2015 an employee was observed standing on the second floor top plate, securing roof trusses.  The worker was not using any form of fall protection and was thus exposed to a fall hazard of greater than 18 to the ground below.
