29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: a) On or about March 12, 2015; 520 Big Red Taylor Lift Truck, Model TX1520M: Otokumpu Stainless USA, LLC, (correcting employer) failed to ensure the fork lift truck which had items such as but not limited to parking brake and manufactured horn were repaired prior to allowing Phoenix Services, LLC, (controlling employer) to continue using it. A Phoenix Services, LLC, employee was operating the fork lift in with the manufactured horn and parking brake indicating issues on the daily inspection report which exposed employees to the hazards associated with faulty equipment.
