29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer. a) 16 Wintergreen Ct., Jackson, NJ: On or about March 12, 2015, Lennar Homes, the controlling employer for this jobsite, had not initiated a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, sub-contractor employees were conducting roofing activities without proper use of fall protection. Additionally, ladders used to access the roof were found to be damaged and the rails did not extend three feet above the landing area. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
