29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered a) At the workplace, in the yard, on or about 3/17/15: An employee was operating a Caterpillar M322D excavator without wearing the available seatbelt and while standing inside the cab where the manufacturers instructions for safe operation of the equipment direct that the operator is seated with the seatbelt worn. This unsafe operation was in plain view and interviews indicate that this employee had operated this and other equipment in a similar fashion prior to his fatality. Abatement documentation must be submitted for this item.
