29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:     Respirators with chemical cartridges were used by employees on a voluntary basis during tanker and hopper entry and during some welding done on truck trailers.  No program was implemented to determine if employees were medically able to use the respirator.

29 CFR 1910.146(d)(4)(i): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not provide, at no cost to the employees, testing and monitoring equipment needed to comply with 29 CFR 1910.146(d)(5):     Employees enter  tankers and hopper trailers which were used to carry gasoline or other chemicals, to do cleaning, inspections and repairs.  No testing equipment capable of testing  for residual levels of chemicals that could be contained in the confined space was provided.
