29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  Warehouse - On or about March 19, 2015, the employer did not ensure that all employees allowed to operate the Crown sit downs and Crown order pickers were trained and evaluated in accordance with paragraph (l), thereby exposing employees to struck-by hazards.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  Warehouse - On and about March 19, 2015. The employees were required to operate powered industrial vehicles (PIV's). The employer did not ensure that the PIV's were examined before they were placed into service.

29 CFR 1910.176(b): Secure storage. Storage of material shall not create a hazard. Bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse.  Warehouse - On or about March 19, 2015, following storage racks were not properly maintained to prevent collapsing, in that up rights, stress bars and cross members were damaged, thereby exposing employees to the hazards associated with unstable stored materials.  1. 29 CFR 1910.303(g)(2)(i): Except as elsewhere required or permitted by this standard, live parts of electric equipment operating at 50 volts or more shall be guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the following means:  Warehouse northeast wall - On or about March 19, 2015, the cable on the battery charger was defective in that the wires were frayed. Employees were thereby exposed to electrical shock.
