The painter had not been given a medical evaluation.

The painter had not been fit-tested.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   (a) At the facility, a written hazard communication program had not been developed and implemented.  Employees at the facility are exposed to welding fumes, acetylene and Zep-A Lume (aluminum cleaner) during fabrication.  The painter is exposed to paint fumes that contain chemicals such as xylene (54.52%), V M & P naphtha (3.3%), n-methyl pyrrolidone, mineral spirits, colbalt drier (0.20%), VM and P naphtha (3.05%), light chrome yellow (22.36%) and SC-100 (8.21%).
