The ladder was designed to be used with its 2 pieces connected as one.   b) On or about March 20, 2015 and at times prior thereto at the jobsite; sub-contractors employees used a closed a-frame ladder on its side to access the first floor from the ground level.  The ladder was designed to be used in its open position.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs,  debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:      a)  On or about March 20, 2015 and at times prior thereto at the jobsite; there was a large amount of insulation, scrap wood, wood planks with nails protruding, and nails throughout the worksite where employees and sub-contractor's employees were working and walking.      The Baker Residential Limited Partnership was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.25(a), which was contained in OSHA inspection number 776701, citation number 1, item number 1 and was affirmed as a final order on 3-28-2013, with respect to a workplace located at 2202 Hawthorn Way, New Windsor, NY 12553.
