29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): A.) Reid Stores, Inc. dba Crosby's / Tim Hortons #98, 7 East Columbus Avenue, Corry, PA 16407, on or about March 17, 2015 and times prior thereto: Employees on-site utilize cleaning products including, but not limited to, Diversey Suma Mirrolite Coffee / Tea Pot Destainer and Machine Detergent, Diversey Stride Citrus HC Neutral Cleaner, and JohnsonDiversey Crew NA Non-Acid Bowl and Bathroom Disinfectant Cleaner. The company's written hazard communication program lacked several elements including, but not limited to, a description of the labeling system used, procedures to review and update label information when necessary, designating a person responsible for obtaining and maintaining the MSDSs, and procedures to follow when the MSDSs are not received at the time of the first shipment. B.) Reid Stores, Inc. dba Crosby's / Tim Hortons #98, 7 East Columbus Avenue, Corry, PA 16407, on or about March 17, 2015 and times prior thereto: Employees on-site utilize cleaning products including, but not limited to, Diversey Suma Mirrolite Coffee / Tea Pot Destainer and Machine Detergent, Diversey Stride Citrus HC Neutral Cleaner, and JohnsonDiversey Crew NA Non-Acid Bowl and Bathroom Disinfectant Cleaner. The company's written hazard communication program did not include a list of the hazardous chemicals at the location.
