29 CFR 1926.451(c)(2): Supported scaffold poles, legs, post, frames, and uprights were not erected on base plate and mud sills, or other adequate firm foundation:    a) 20 Reid Street, Elizabeth, NJ 07201. The employer allowed his employee to work on and from Alum-A-Pole pump jack scaffold when the scaffold had not been erected on base plates, mud sills or other adequate firm foundations exposing the employee to fall hazards in the event of scaffold failure.     Condition occurred on or about 03/24/15.

29 CFR 1926.451(f)(7): Scaffolds erected, moved, dismantled or altered were not performed under the supervision and direction of a competent person qualified in scaffolds:    a) 20 Reid Street, Elizabeth, NJ 07201. The employer allowed his employee to work on and from Alum-A-Pole pump jack scaffold when the scaffold had not been erected under the supervision and direction of a Competent Person qualified in scaffold exposing the employee scaffold hazards.    Condition occurred on or about 03/24/15.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of walking/working platforms:    a) 20 Reid Street, Elizabeth, NJ 07201. The employer allowed his employee to work on and from Alum-A-Pole pump jack scaffold with no fall protection system in place in that guardrails were not installed along all open sides and ends of walking/working platforms exposing the employee to fall hazards.    Condition occurred on or about 03/24/15.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented:    a) 20 Reid Street, Elizabeth, NJ 07201. The employer allowed his employee to work on the roof of a three story home installing roofing materials with no fall protection systems in place exposing the employee to fall hazards in excess of 25 feet from the upper eave to the ground below.     Condition occurred on or about 03/24/15.      Nestor's Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 891688, citation number 1, item number 1 and was affirmed as a final order on 04/17/13, with respect to a workplace located at 954 West Grand Street, Elizabeth, NJ 07202.
