OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm. An employee was exposed to a fall and caught between hazard while working on the elevated bucket of a hydraulic excavator. a) On or about March 26, 2015- Job site at 252-89 Brattle Avenue, Little Neck NY 11362 The employer instructed an employee to work on a window, approximately 13 feet above the next lower level, while standing on the bucket of a Case 580 Super M, hydraulic excavator. Among other methods, feasible and acceptable methods to correct this hazard is: 1. Prohibit employees to work on the bucket of any hydraulic excavator. 2. Follow the Construction Industry Manufacturers Association (CIMA) recommendations for the safe operating procedures contained in their manual. "Safety Manual for Users, Operators, and maintenance Personnel - Hydraulic Excavator".

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) On or about March 26, 2014- job site at 252-89 Brattle Avenue, Little Neck, NY 11362 The employer permitted employees to work at an active construction site, where overhead work was being performed, without protective helmets. WRITTEN ABATEMENT CERTIFICATION IS NOT REQUIRED.
