29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about 03/25/15, at the Dunkin Donuts under construction, located at 2299 Brighton Henrietta Town Line Road, in Rochester, New York, an employee working on a roof measuring 16 feet above grade level was not protected from falling by use of conventional fall protection. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was a grasping device, such as a grabrail, provided to assist the employee in mounting and dismounting the the ladder: (a) On or about 03/25/15, the Dunkin Donuts under construction, located on 2299 Brighton Henrietta Town Line Road, in Rochester, New York, a portable ladder, which did not extend at least 3 feet above the landing, was in use to access the roof. NO ABATEMENT CERTIFICATION REQUIRED
