29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. There was no frequent and regular inspections being performed by a competent person to ensure the job=site, materials and equipment such as residential fall protection systems and/or devices were being maintained and utilized in a safe condition.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502: Located on the east side of a residential structure, two employees not utilizing an adequate fall protection system were observed standing at the edge of a framed wall while reaching downwards to raise up a roof truss were exposed to a fall hazard greater than 12 feet above the ground below.
